Summary
This analysis paves the way for the further research on available forums of the resolution of public procurement disputes. It explains how the possible pool of available forums for the resolution of public procurement disputes might be extended to the concept of international (or local) commercial arbitration. The author seeks to explain why the public procurement disputes related to the procedures of procurement are exempted from commercial arbitration jurisdiction. At the same time it is contended that disagreements that arise from the public contract are within the realm ADR. However, they a limited to some extent and this is explained in the present publication.
